TERMS & CONDITIONS OF SALE

Last Updated: September 29, 2026

These Terms & Conditions of Sale (“Terms”) apply to purchases of products and services from Cone Pros, a brand of Dank’s Industries, LLC (“Cone Pros,” “we,” “us,” or “our”), including purchases made through our website, by purchase order, quotation, invoice, email, or other agreed ordering method.

By placing an order with Cone Pros, the customer (“Customer,” “you,” or “your”) agrees to these Terms. Any different or additional terms contained in a Customer purchase order or other document will not apply unless expressly accepted by Cone Pros in writing.

1. Orders & Acceptance

All orders are subject to acceptance by Cone Pros. Receipt of an order, payment, purchase order, or other communication does not obligate Cone Pros to accept or fulfill an order.

We may decline or cancel an order before production or shipment when reasonably necessary, including because of product availability, pricing or specification errors, payment issues, regulatory concerns, or circumstances outside our reasonable control. If we cancel an order after receiving payment and no amounts are otherwise properly due, the applicable payment will be refunded.

2. Pricing & Payment

Prices are stated in U.S. dollars unless otherwise specified. Prices may change without notice, but price changes will not affect an accepted order unless the Customer subsequently requests a change to that order.

Applicable taxes, shipping, freight, duties, customs charges, special handling, tooling, setup fees, artwork charges, and other costs are additional unless expressly included in the applicable quotation or invoice.

Payment terms are those stated on the applicable quotation, invoice, or order confirmation. Cone Pros may require deposits or full payment before beginning custom production or shipping products.

3. Ready-Stock Products

Ready-stock products are subject to availability. Product photographs, descriptions, measurements, and colors are intended to provide an accurate representation but minor variations may occur between production batches.

Availability displayed on the website is not a guarantee that inventory will remain available until an order has been accepted and processed.

4. Custom & Made-to-Order Products

Custom products are manufactured according to the specifications, artwork, materials, and approvals associated with the applicable order.

Custom manufacturing may involve reasonable variations in dimensions, color, printing, materials, positioning, finish, appearance, weight, and quantity that are inherent to the applicable materials and manufacturing processes.

Unless otherwise agreed in writing, production specifications and tolerances customarily applicable to the relevant product and manufacturing process will apply.

Additional requirements governing artwork, proofs, approvals, intellectual property, production tolerances, and custom orders are contained in our Custom Manufacturing & Artwork Policy, which is incorporated into these Terms.

5. Customer Approvals

When Cone Pros provides an artwork proof, prototype, sample, specification sheet, or other approval document, the Customer is responsible for reviewing it carefully before approval.

Customer approval authorizes Cone Pros to proceed based on the approved specifications. Cone Pros is not responsible for errors that were present in materials approved by the Customer, including spelling, artwork, dimensions, positioning, colors, or other approved specifications.

Changes requested after approval may result in additional charges and revised production schedules.

6. Lead Times

Any production, processing, or delivery time provided by Cone Pros is an estimate unless expressly identified in writing as a guaranteed deadline.

For custom products, quoted lead times generally begin only after Cone Pros has received all required payments, final artwork, specifications, approvals, and other information necessary to begin production.

Delays caused by Customer changes, late approvals, material availability, carriers, customs, governmental action, natural events, labor disruptions, or other circumstances outside Cone Pros’ reasonable control may extend estimated completion or delivery dates.

7. Shipping, Inspection & Claims

Shipping and delivery are governed by our Shipping & Delivery Policy.

Customers should inspect products promptly upon receipt. Claims involving shortages, incorrect products, shipping damage, or alleged manufacturing defects must be submitted according to our Returns, Refunds & Claims Policy.

Failure to submit a claim within the applicable claim period may limit the remedies available to the Customer to the extent permitted by law.

8. Cancellations & Changes

Ready-stock orders may be changed or canceled only before processing or shipment, subject to our applicable policies.

Because custom products are produced specifically for the Customer, custom orders generally cannot be canceled after materials have been committed, production has begun, or other nonrecoverable costs have been incurred.

If Cone Pros agrees to a cancellation or modification, the Customer remains responsible for work completed, materials purchased or committed specifically for the order, tooling, setup costs, and other reasonable nonrecoverable costs attributable to the order.

9. Customer-Supplied Artwork & Intellectual Property

The Customer represents and warrants that it owns or has all necessary rights and permissions to use any trademarks, logos, artwork, designs, text, photographs, or other materials supplied to Cone Pros.

The Customer authorizes Cone Pros and its manufacturing partners to reproduce those materials solely as reasonably necessary to fulfill the Customer’s order.

Cone Pros retains ownership of its pre-existing intellectual property, proprietary manufacturing methods, designs, processes, tooling, know-how, and other intellectual property except where otherwise expressly agreed in writing.

10. Product Use & Regulatory Responsibility

Cone Pros takes product quality and applicable regulatory requirements seriously. However, laws and regulations differ by product, intended use, market, and jurisdiction.

Unless Cone Pros expressly provides a specific written certification or representation for a particular product, the Customer is responsible for determining whether its finished product, packaging, labeling, advertising, distribution, and intended use comply with laws and regulations applicable to the markets in which the Customer conducts business.

Nothing on the Cone Pros website or in general marketing materials should be interpreted as legal or regulatory advice.

11. Limited Warranty

Cone Pros warrants that products will materially conform to the specifications accepted for the applicable order, subject to reasonable manufacturing tolerances and the limitations stated in these Terms and our other applicable policies.

If Cone Pros confirms that products materially fail to conform because of a manufacturing defect for which Cone Pros is responsible, Cone Pros may, as appropriate and subject to applicable law, repair or replace the affected products, provide a credit, or refund the amount paid for the affected products.

This warranty does not cover damage or problems resulting from improper storage or handling, modification after delivery, misuse, normal variation within applicable tolerances, or use inconsistent with the product's specifications or intended purpose.

12. Limitation of Liability

To the fullest extent permitted by applicable law, Cone Pros will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including lost profits, lost business, or loss of goodwill, arising from an order or product.

To the fullest extent permitted by applicable law, Cone Pros’ aggregate liability arising from a particular order will not exceed the amount actually paid to Cone Pros for the products or services giving rise to the claim.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

13. Force Majeure

Cone Pros will not be responsible for delay or failure to perform caused by circumstances beyond its reasonable control, including natural disasters, fire, severe weather, war, civil disturbance, governmental action, labor disruption, transportation interruption, customs delays, supply shortages, utility failures, or similar events.

14. Relationship With Other Policies

These Terms should be read together with Cone Pros’ Shipping & Delivery Policy, Returns, Refunds & Claims Policy, Custom Manufacturing & Artwork Policy, Privacy Policy, Website Terms of Use, Regulatory & Intended-Use Notice, and other policies applicable to a particular transaction.

If a specific written quotation, order confirmation, or agreement expressly conflicts with these Terms, the specifically negotiated written provision will control with respect to that conflict.

15. Governing Law & Disputes

This is one section I would not finalize blindly. Since Dank’s Industries is a California LLC but Cone Pros may sell nationally and internationally, we should deliberately choose the governing-law, venue, dispute-resolution, attorney-fee, and potentially arbitration provisions rather than dropping in generic boilerplate.

16. Changes to These Terms

Cone Pros may update these Terms periodically. Changes will apply prospectively from the date the revised Terms are posted unless otherwise required by law.

The Terms applicable to an accepted order will generally be those in effect when the order was accepted, except where the parties subsequently agree otherwise in writing.

SHIPPING & DELIVERY POLICY

Last Updated: September 29, 2026

This Shipping & Delivery Policy applies to products purchased from Cone Pros, a brand of Dank’s Industries, LLC (“Cone Pros,” “we,” “us,” or “our”).

1. Processing & Production Times

Ready-stock products are generally processed for shipment after order acceptance and receipt of required payment.

Custom and made-to-order products require production before shipment. Estimated production times may vary depending on product type, quantity, materials, customization, artwork approval, and manufacturing requirements.

Quoted production and processing times are estimates unless Cone Pros expressly agrees in writing to a guaranteed deadline.

2. When Custom Lead Times Begin

Unless otherwise stated in writing, the production lead time for a custom order begins only after Cone Pros has received all items necessary to begin production, including:

  • Required deposit or payment
  • Final artwork and specifications
  • Customer approval of applicable proofs
  • Required product selections and information

Customer-requested changes after approval may restart or extend the production timeline.

3. Shipping Costs

Shipping, freight, insurance, special handling, duties, taxes, and similar charges are not included in product pricing unless expressly stated in the applicable quotation or order confirmation.

Shipping charges presented during checkout or on a quotation may be estimates when final shipping dimensions, weights, destination charges, or freight requirements are not yet known.

If actual freight requirements materially differ from an estimate, Cone Pros will notify the Customer when additional payment is required before shipment.

4. Delivery Estimates

Estimated delivery dates are provided for convenience and are not guaranteed unless Cone Pros expressly agrees otherwise in writing.

Once a shipment has been transferred to a carrier, transit times may be affected by circumstances outside our control, including weather, carrier operations, customs processing, port congestion, governmental action, and transportation disruptions.

A carrier's delay does not automatically constitute a delay in production by Cone Pros.

5. Domestic Shipping

Domestic orders may be shipped using parcel carriers, freight carriers, or other transportation services appropriate for the size and nature of the shipment.

Tracking information will be provided when available.

Large commercial orders may require palletized or freight delivery. The Customer is responsible for providing accurate information regarding receiving requirements, including whether a loading dock, liftgate, appointment, or other special delivery service is required.

6. International Shipping

Cone Pros may ship products internationally where available and legally permissible.

International Customers are responsible for determining whether products may lawfully be imported into the destination country and for providing information or documentation reasonably required for shipment.

Unless expressly included in a written quotation, the Customer is responsible for applicable customs duties, tariffs, import taxes, brokerage fees, clearance charges, and other destination-country charges.

Customs inspections or clearance procedures may delay delivery. Cone Pros cannot guarantee customs clearance times.

7. Import Restrictions & Customs

The Customer is responsible for understanding import restrictions applicable to the products being ordered.

If a shipment is delayed, refused, seized, returned, or otherwise affected by customs or another governmental authority because of an import restriction applicable to the Customer or destination, Cone Pros will work reasonably with the Customer where possible but cannot guarantee recovery of the shipment.

Any refund or credit will depend on whether products are returned to Cone Pros in resalable condition and on the costs already incurred, subject to applicable law.

8. Shipping Addresses

Customers are responsible for providing complete and accurate shipping and contact information.

Cone Pros is not responsible for additional costs or delays resulting from an incorrect or incomplete address supplied by the Customer.

Address changes requested after an order has shipped may be subject to carrier fees and cannot always be accommodated.

9. Risk of Loss & Title

The point at which title and risk of loss transfer may depend on the shipping arrangement applicable to an order.

For commercial, freight, and international transactions, the applicable quotation, invoice, purchase order acceptance, or agreed shipping term may specify the controlling Incoterm or other delivery term.

Where no specific delivery term has been agreed, applicable law and the shipping terms stated in the order documentation will determine the transfer of title and risk.

10. Inspection Upon Delivery

Customers should inspect shipments promptly upon arrival.

Before accepting a freight shipment, Customers should inspect the exterior packaging for visible damage whenever reasonably possible and note visible damage on the carrier's delivery documentation.

Photographs of damaged cartons, pallets, products, and shipping labels should be retained because they may be required to process a claim.

11. Missing, Damaged or Incorrect Shipments

If products arrive damaged, quantities are missing, or the incorrect products are delivered, contact Cone Pros promptly at info@conepros.com.

Please retain the products and all original packaging until the claim has been resolved. We may request photographs, shipping documents, lot information, quantities affected, or other information reasonably necessary to investigate the claim.

Claims are governed by our Returns, Refunds & Claims Policy.

12. Refused & Undeliverable Shipments

If a shipment is refused or cannot be delivered because of circumstances attributable to the Customer—including an incorrect address, failure to accept delivery, unpaid destination charges, or unavailable receiving facilities—the Customer may be responsible for resulting freight, storage, return shipping, redelivery, and other reasonable costs.

Custom products and other nonreturnable goods do not become returnable merely because delivery was refused.

13. Split Shipments

Cone Pros may ship an order in multiple shipments when reasonably necessary because of inventory availability, production schedules, manufacturing locations, or transportation requirements.

Where appropriate, we will communicate significant split-shipment arrangements with the Customer.

14. Delays Beyond Our Control

Cone Pros is not responsible for delivery delays caused by events outside its reasonable control, including carrier disruptions, severe weather, natural disasters, labor disruptions, customs delays, port congestion, governmental actions, transportation interruptions, or similar circumstances.

We will make reasonable efforts to assist Customers in obtaining information regarding delayed shipments.

RETURNS, REFUNDS & CLAIMS POLICY

Last Updated: September 29, 2026

This Returns, Refunds & Claims Policy applies to products purchased from Cone Pros, a brand of Dank’s Industries, LLC (“Cone Pros,” “we,” “us,” or “our”).

Because Cone Pros offers both ready-stock merchandise and products manufactured specifically for individual customers, return eligibility depends on the type of product purchased.

1. Ready-Stock Products

Unused and unopened ready-stock products may be eligible for return with prior authorization from Cone Pros.

Unless otherwise agreed in writing, return requests for ready-stock products should be submitted within 30 days of delivery.

Products must be returned in their original condition and packaging and must be suitable for resale.

Shipping charges and other costs associated with the original order are generally nonrefundable unless the return results from an error by Cone Pros or applicable law requires otherwise.

2. Custom & Made-to-Order Products

Custom, personalized, printed, branded, specially manufactured, or otherwise made-to-order products are generally final sale and nonreturnable.

This includes products manufactured to Customer specifications involving custom dimensions, colors, materials, printing, engraving, artwork, packaging, or other customization.

A custom product is not considered defective merely because of reasonable variations inherent in its materials or manufacturing process.

This limitation does not affect claims involving products that materially fail to conform to the approved specifications because of a manufacturing defect or error for which Cone Pros is responsible.

3. Return Authorization

Products should not be returned without first obtaining authorization from Cone Pros.

To request a return, contact info@conepros.com and provide the order or invoice number, products and quantities involved, and the reason for the requested return.

If the return is approved, Cone Pros will provide applicable return instructions.

Unauthorized returns may be refused or returned to the sender.

4. Damaged, Defective or Incorrect Products

If you believe products arrived damaged, defective, incorrect, or materially different from the approved order specifications, contact Cone Pros promptly.

Please provide:

  • Order or invoice number
  • Product and quantity affected
  • Description of the issue
  • Photographs clearly showing the affected products
  • Photographs of packaging and shipping damage, when applicable
  • Lot, carton, or identifying information when available

Please retain the affected products and their packaging while the claim is being reviewed.

Cone Pros may request samples or additional information reasonably necessary to determine the nature and extent of the issue.

5. Claims Period

Claims for visible shipping damage, shortages, incorrect products, or readily apparent manufacturing issues should be reported within 10 business days of delivery.

Latent manufacturing defects that could not reasonably have been identified during an initial inspection should be reported promptly after discovery.

Nothing in this policy shortens a period or eliminates a remedy that cannot lawfully be limited.

6. Manufacturing Tolerances

Many Cone Pros products involve natural materials and specialized manufacturing processes. Minor variations may occur between individual products and production runs.

Depending on the product, reasonable variations may include differences in:

  • Dimensions and weight
  • Paper or wrapper texture
  • Natural material appearance
  • Color and shade
  • Printing color or registration
  • Artwork positioning
  • Tip, cone, or tube alignment
  • Finish
  • Quantity

Variations within the applicable manufacturing tolerance do not, by themselves, constitute defects.

Where a particular tolerance is important to the Customer's application, it should be identified and agreed upon before production.

7. Color & Natural Material Variation

Colors displayed digitally, on monitors, or in electronic proofs may differ from physical materials and printed products.

Natural products such as hemp wrapper, paper, bamboo, wood, and other plant-derived materials may also exhibit differences in grain, texture, shade, thickness, or appearance.

These natural and commercially reasonable variations are not considered defects unless the products materially fail to meet an expressly agreed specification.

8. Approved Artwork & Specifications

For custom orders, Cone Pros manufactures according to the final artwork, proofs, samples, specifications, or other materials approved by the Customer.

Customer-approved spelling, artwork, dimensions, colors, placement, product selections, and other specifications generally cannot serve as the basis for a defect claim after production.

If the finished product differs materially from the approved specifications because of an error attributable to Cone Pros or its manufacturing process, the Customer may submit a claim under this policy.

9. Resolution of Valid Claims

If Cone Pros determines that a product materially fails to conform to the applicable order because of an error or manufacturing defect for which Cone Pros is responsible, we may provide an appropriate remedy, which may include:

  • Replacement of the affected products
  • Reproduction or correction
  • Account credit
  • Partial refund
  • Refund of the amount paid for the affected products

The appropriate remedy will depend on the nature and extent of the issue, subject to applicable law.

A defect affecting a portion of an order does not automatically entitle the Customer to reject or receive a refund for conforming products.

10. Return Shipping

If a return results from a verified Cone Pros error or covered manufacturing defect, Cone Pros will provide instructions regarding return or disposition of the affected products.

For discretionary returns of conforming ready-stock products, the Customer is generally responsible for return shipping costs.

Customers should not destroy, dispose of, alter, or return allegedly defective products until instructed to do so by Cone Pros if they intend to pursue a claim.

11. Refund Processing

Approved refunds will generally be issued using the original payment method where practical.

Processing times may vary depending on the payment provider or financial institution.

Refunds apply only to amounts approved by Cone Pros for the affected products or charges and do not automatically include freight, duties, taxes, brokerage fees, or other third-party expenses.

12. Order Cancellations

Cancellation is different from a return.

Ready-stock orders may generally be canceled before processing or shipment when operationally possible.

Custom orders may become noncancelable once materials have been purchased or committed, artwork or tooling has been prepared, production has begun, or other nonrecoverable costs have been incurred.

Cancellation of custom manufacturing orders is addressed further in our Terms & Conditions of Sale and Custom Manufacturing & Artwork Policy.

13. Chargebacks & Disputed Payments

We encourage Customers to contact Cone Pros directly if there is a problem with an order so that we have an opportunity to investigate and resolve it.

Nothing in this policy restricts any lawful right a Customer may have to dispute a transaction through its payment provider.

14. Contact

CUSTOM MANUFACTURING & ARTWORK POLICY

Last Updated: September 29, 2026

This Custom Manufacturing & Artwork Policy applies to custom, printed, branded, personalized, specially manufactured, or made-to-order products purchased from Cone Pros, a brand of Dank’s Industries, LLC (“Cone Pros,” “we,” “us,” or “our”).

Custom manufacturing involves materials, production processes, and specifications unique to each order. This policy explains how artwork, approvals, samples, tolerances, production changes, and related matters are handled.

1. Custom Orders

A custom order may include modifications or selections involving product dimensions, materials, colors, printing, engraving, labels, bands, packaging, artwork, components, finishes, or other specifications.

The specifications stated in the applicable quotation, order confirmation, approved artwork, proof, specification sheet, or other written approval form the basis for production.

2. Artwork Requirements

Customers are responsible for supplying artwork that meets the technical requirements provided by Cone Pros.

Depending on the manufacturing process, we may require vector artwork, specific file formats, outlined fonts, minimum line thicknesses, color specifications, bleed areas, or other production requirements.

Artwork requiring significant modification, recreation, color separation, or production preparation may be subject to additional charges. We will notify the Customer when additional artwork charges are required.

3. Artwork Proofs

When applicable, Cone Pros will provide a digital proof or other approval document before production.

Proofs are intended to confirm matters such as:

  • Artwork and text
  • General positioning
  • Product selection
  • Dimensions or print area
  • Colors or specified color references
  • Other applicable production specifications

Customers are responsible for carefully reviewing all proofs before approval.

4. Approval Authorizes Production

Customer approval of a proof, specification, sample, or other production document authorizes Cone Pros to manufacture the product according to the approved information.

Before approving a proof, Customers should verify spelling, artwork, orientation, dimensions, positioning, colors, product type, quantity, and other specifications.

Cone Pros is generally not responsible for errors that appear in Customer-approved materials.

Changes requested after approval may result in additional costs and revised lead times.

5. Digital Proofs & Physical Products

Digital proofs are representations of the intended product and are not exact physical reproductions.

Monitor calibration, screen brightness, file rendering, printing methods, substrates, natural materials, coatings, and other factors can affect the appearance of the finished product.

Accordingly, colors displayed on a screen may differ from the physical product.

Where precise color reproduction is important, Customers should discuss available color-matching options with Cone Pros before approving production.

6. Pantone & Specified Colors

When a Pantone or other recognized color specification is agreed upon, Cone Pros will use commercially reasonable efforts to reproduce that color within the capabilities of the applicable printing process and material.

Exact color reproduction cannot always be guaranteed across different materials, printing methods, finishes, or production runs.

A specified color therefore establishes a production target rather than a guarantee of visually identical reproduction unless Cone Pros expressly agrees otherwise in writing.

7. Samples & Prototypes

Samples and prototypes may be available for certain custom products.

Unless expressly agreed otherwise, a sample is intended to demonstrate general design, construction, materials, or appearance and does not eliminate reasonable manufacturing variation in full-scale production.

Prototype development, samples, tooling, shipping, and setup may involve additional charges.

Approval of a sample authorizes production based on the approved sample and any associated written specifications.

8. Natural Materials

Many Cone Pros products incorporate paper, hemp, bamboo, wood, and other natural or plant-derived materials.

Natural materials inherently vary. Differences in grain, fibers, texture, shade, thickness, surface appearance, and other characteristics may occur between products and production runs.

Reasonable natural variation is not considered a manufacturing defect.

9. Manufacturing Tolerances

Custom manufacturing involves reasonable production tolerances.

Depending on the product and process, variations may occur in:

  • Dimensions
  • Weight
  • Paper or wrapper thickness
  • Color and shade
  • Printing registration
  • Artwork placement
  • Cutting and forming
  • Cone or tube shape
  • Tip positioning
  • Seams and closures
  • Finish
  • Packaging
  • Other production characteristics

Products falling within the applicable agreed or commercially reasonable manufacturing tolerance are considered conforming products.

If a particular dimension or characteristic is critical to the Customer's application, the Customer should identify that requirement before quotation and production so an appropriate specification and tolerance can be established.

10. Production Quantities

Certain custom manufacturing processes may produce quantities slightly above or below the quantity ordered.

When an overrun or underrun tolerance applies, Cone Pros will communicate the applicable tolerance when practical or include it in the relevant quotation or production specifications.

Customers may be invoiced for accepted overruns when this has been disclosed or agreed as part of the applicable order.

We should avoid inserting an arbitrary industry percentage here; your actual tolerance should depend on the product and manufacturing process.

11. Changes After Approval

Changes requested after final approval may require new artwork, materials, tooling, setup, samples, or production work.

Cone Pros will advise the Customer of material additional charges or schedule changes resulting from a requested modification before proceeding when reasonably practicable.

If production has already begun, some changes may not be possible.

12. Customer-Supplied Intellectual Property

By providing a trademark, logo, artwork, photograph, design, text, or other material to Cone Pros, the Customer represents that it owns the material or has sufficient authorization to use and reproduce it.

The Customer authorizes Cone Pros and its manufacturing partners to reproduce Customer-supplied materials as reasonably necessary to quote, develop, manufacture, package, and fulfill the Customer's products.

Cone Pros may decline artwork that we reasonably believe infringes third-party rights or violates applicable law.

13. Cone Pros Intellectual Property

Cone Pros retains ownership of its pre-existing intellectual property and proprietary materials, including manufacturing methods, processes, know-how, product designs, templates, systems, and other intellectual property, except where otherwise expressly agreed in writing.

Payment for a custom product does not automatically transfer ownership of Cone Pros' underlying manufacturing processes or intellectual property.

14. Custom Product Development

Some projects involve more than applying Customer artwork to an existing product and may require Cone Pros to develop a new construction, component, manufacturing technique, tooling solution, material combination, or other product innovation.

Ownership and exclusivity of intellectual property created through substantial custom product development should be established separately in writing when applicable.

Unless expressly agreed otherwise, purchasing a custom-manufactured product does not by itself grant the Customer exclusive rights to general product concepts, manufacturing techniques, processes, materials, dimensions, or functional features independently developed or owned by Cone Pros.

This provision is particularly important for Cone Pros because product development is part of the business—not merely contract printing.

15. Tooling, Dies, Screens & Production Materials

Custom manufacturing may require printing screens, dies, molds, plates, fixtures, digital production files, tooling, or other manufacturing materials.

Payment of a setup or tooling charge does not necessarily constitute a purchase or transfer of ownership of the underlying production equipment or manufacturing materials.

Ownership, storage, reuse, maintenance, and availability of specialized Customer-specific tooling may be addressed in the applicable quotation or separate written agreement.

16. Customer-Supplied Components

If Cone Pros agrees to manufacture using materials or components supplied by a Customer, the Customer is responsible for ensuring those materials are suitable for the intended application unless Cone Pros expressly agrees to assume that responsibility.

Additional quantities may be required to account for setup, testing, spoilage, or normal manufacturing loss.

Cone Pros is not responsible for defects attributable to Customer-supplied materials unless the issue results from Cone Pros' handling or manufacturing process.

17. Lead Times

Custom production lead times are estimates unless expressly guaranteed in writing.

Unless otherwise stated, lead time begins after Cone Pros has received all required:

  • Payments or deposits
  • Final artwork
  • Product specifications
  • Proof or sample approvals
  • Customer-supplied materials or information

Changes, delayed approvals, material availability, production conditions, transportation, customs, or circumstances outside our reasonable control may affect completion dates.

18. Cancellation of Custom Orders

Because custom manufacturing may require materials and production capacity to be committed specifically to a Customer, custom orders may become partially or fully noncancelable as work progresses.

If Cone Pros agrees to cancel an order after costs have been incurred, the Customer remains responsible for completed work and reasonable nonrecoverable costs, including Customer-specific materials, printing, tooling, setup, artwork preparation, samples, and production already performed.

19. Confidentiality & Proprietary Projects

Cone Pros understands that custom development may involve unreleased products, artwork, packaging, or other commercially sensitive information.

However, this policy by itself does not create a comprehensive nondisclosure agreement. Projects requiring confidential treatment of proprietary information should be covered by an appropriate written confidentiality or nondisclosure agreement.

20. Product Photography & Portfolio Use

I recommend making this opt-in rather than automatic. Cone Pros should not assume it can publicly display a customer's unreleased or private-label product simply because it manufactured it.

A clean provision would be:

Cone Pros will not intentionally use Customer-specific branding or custom product artwork in public marketing materials without permission where the product or branding is not already publicly available or such use has not otherwise been authorized.

You can separately ask customers for permission to feature especially good projects.

21. Relationship to Other Policies

This policy should be read together with our Terms & Conditions of Sale and Returns, Refunds & Claims Policy.

If an applicable quotation or written agreement establishes a specific manufacturing specification or tolerance that differs from this general policy, the specifically agreed provision will control for that order.

10. Data Security

We use reasonable administrative, technical, and organizational measures designed to protect personal information against unauthorized access, loss, misuse, alteration, or disclosure.

However, no internet transmission or information-storage system can be guaranteed to be completely secure.

Where those laws apply to Cone Pros, eligible California residents may request information regarding categories of personal information collected, sources of that information, purposes for collection and use, categories of recipients, and other disclosures required by law.

Eligible residents may also have rights to request access, correction, or deletion and to opt out of certain sales or sharing of personal information.

The applicability of particular rights depends on the law and circumstances.

13. International Visitors

Cone Pros operates from the United States and works with customers and manufacturing partners internationally.

If you provide information from outside the United States, your information may be processed in the United States or other countries where Cone Pros or its service providers operate.

Those countries may have data-protection laws different from those in your jurisdiction.

Where legally required, appropriate mechanisms will be used for applicable international transfers.

14. Children's Privacy

The Cone Pros website and services are intended for businesses and adults and are not directed to children.

We do not knowingly collect personal information from children through services directed toward them. If we learn that we have collected information from a child contrary to applicable law, we will take appropriate steps to address it.

WEBSITE TERMS OF USE

Last Updated: September 29, 2026

These Website Terms of Use (“Terms of Use”) govern your access to and use of the Cone Pros website and its content, features, tools, and services.

The website is operated by Dank’s Industries, LLC under the Cone Pros brand (“Cone Pros,” “we,” “us,” or “our”).

By accessing or using this website, you agree to these Terms of Use. Purchases from Cone Pros are also subject to our Terms & Conditions of Sale and other applicable policies.

1. Permitted Use

You may use this website for lawful purposes, including reviewing our products and services, requesting information or quotations, submitting product configurations or artwork, and purchasing products where available.

You agree not to use the website in a manner that violates applicable law, interferes with its operation, compromises its security, or infringes the rights of Cone Pros or any third party.

2. Prohibited Activities

You may not:

  • Attempt to gain unauthorized access to the website, accounts, servers, or systems
  • Introduce malware, malicious code, or other harmful material
  • Interfere with the operation or security of the website
  • Use automated systems to excessively scrape, harvest, or extract website content or data
  • Circumvent security or access-control measures
  • Impersonate another person or organization
  • Submit false, fraudulent, infringing, or unlawful information or materials
  • Use Cone Pros content or intellectual property in an unauthorized manner

We may restrict or terminate access when we reasonably believe the website is being misused.

3. Website Content

We make reasonable efforts to provide accurate and current information. However, website content may occasionally contain typographical errors, inaccuracies, omissions, or outdated information.

Product availability, specifications, dimensions, materials, colors, pricing, lead times, packaging, and other details may change.

Website information does not supersede the specifications contained in an accepted quotation, order confirmation, approved proof, or other written agreement applicable to a particular order.

4. Product Images & Colors

Product photographs, renderings, configurators, digital mockups, and other visual representations are provided to help illustrate products and customization options.

Actual products may differ because of lighting, photography, monitor settings, manufacturing processes, materials, natural variation, and other factors.

Digital representations should not be interpreted as guarantees of exact physical color, texture, dimensions, or appearance unless expressly agreed in writing.

5. Product Configurators & Customization Tools

Cone Pros may provide interactive tools that allow visitors to select materials, colors, tips, dimensions, artwork, packaging, or other product characteristics.

Configurator images and previews are intended primarily for visualization and quotation purposes and do not automatically constitute final production specifications or approved manufacturing proofs.

Final specifications may require review and approval by Cone Pros and the Customer before production.

This provision is particularly important for the Cone Pros product configurator.

6. Quotations & Website Pricing

Prices displayed on the website may apply only to specified products, quantities, configurations, or purchasing conditions.

Custom products may require a separate quotation.

A website submission, product configuration, quote request, shopping cart, or similar interaction does not by itself obligate Cone Pros to manufacture or sell a product until the order has been accepted in accordance with our Terms & Conditions of Sale.

7. Intellectual Property

Unless otherwise indicated, the website and its original content—including text, graphics, photographs, product imagery, illustrations, icons, interface designs, product configurators, software, logos, trademarks, and other materials—are owned by or licensed to Cone Pros and are protected by applicable intellectual-property laws.

You may view and use website content for legitimate personal or business purposes related to evaluating or purchasing Cone Pros products.

No other right or license is granted except as expressly stated.

8. Cone Pros Trademarks & Branding

The Cone Pros name, logo, product names, graphics, and other brand identifiers may constitute trademarks or other protected intellectual property.

Nothing on this website grants permission to use Cone Pros branding in a manner that suggests endorsement, affiliation, authorization, or sponsorship without our permission.

9. Proprietary Products & Designs

Certain products, designs, manufacturing methods, features, technologies, and processes offered or described by Cone Pros may be proprietary or protected by patents, trademarks, copyrights, trade secrets, contractual rights, or other intellectual-property protections.

Displaying or describing such products on the website does not grant visitors a license to reproduce, manufacture, copy, reverse engineer, or commercially exploit protected intellectual property.

10. Customer-Submitted Content

If you submit artwork, logos, designs, specifications, photographs, files, reviews, or other materials through the website, you represent that you have the rights necessary to provide those materials and authorize their use for the requested purpose.

Submitting Customer artwork for quotation or manufacturing does not transfer ownership of that artwork to Cone Pros.

Additional terms governing artwork and custom products are contained in our Custom Manufacturing & Artwork Policy.

11. Reviews & Public Submissions

If the website permits reviews, testimonials, comments, or other material intended for public display, you grant Cone Pros permission to display and use that material in connection with the website and our business, subject to applicable law.

This provision does not apply to private Customer artwork, confidential project files, or other materials submitted solely for quotation or manufacturing.

12. Third-Party Links & Services

The website may contain links to or integrations with third-party websites and services.

Cone Pros does not control those third parties and is not responsible for their content, availability, security, terms, or privacy practices.

A link does not necessarily constitute endorsement.

13. Regulatory Information

Information provided on the website concerning materials, testing, compliance, intended use, or regulatory matters is provided for general informational purposes unless expressly identified as a product-specific certification or representation.

Regulatory requirements vary by product, application, and jurisdiction.

Customers are responsible for evaluating requirements applicable to their finished products, packaging, labeling, marketing, distribution, and intended markets as further described in our Regulatory & Intended-Use Notice.

14. No Professional Advice

Website content is not intended to constitute legal, regulatory, tax, medical, or other professional advice.

Customers should consult appropriate professionals regarding requirements specific to their businesses, products, and jurisdictions.

15. Website Availability

We may modify, suspend, discontinue, or restrict all or part of the website at any time.

We do not guarantee uninterrupted or error-free website availability.

Maintenance, technical failures, third-party services, security events, or other circumstances may temporarily affect website operation.

16. Disclaimer of Website Warranties

To the fullest extent permitted by law, the website and its general informational content are provided on an “as is” and “as available” basis.

Cone Pros does not warrant that the website will always be uninterrupted, error-free, secure, or free of harmful components.

Product warranties and remedies associated with purchases are governed separately by our Terms & Conditions of Sale and related policies.

17. Limitation of Liability

To the fullest extent permitted by applicable law, Cone Pros will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising solely from use of or inability to use the website.

Nothing in these Terms of Use excludes or limits liability that cannot legally be excluded or limited.

18. Indemnification

To the extent permitted by law, you agree to be responsible for claims, losses, or expenses arising from your unlawful misuse of the website, infringement caused by materials you submit, or violation of these Terms of Use.

This provision does not require you to indemnify Cone Pros for claims caused by Cone Pros’ own conduct where such an obligation would be prohibited by law.

19. Privacy

Use of personal information collected through the website is governed by our Privacy Policy.

Cookie and tracking technologies may also be governed by applicable cookie notices and consent controls.

20. Changes to These Terms

We may revise these Terms of Use periodically.

The current version will be posted on the website with an updated “Last Updated” date. Changes generally apply prospectively from the date posted.

21. Governing Law & Disputes

The governing-law and dispute-resolution provisions applicable to website use should ultimately be coordinated with the provisions adopted in the Terms & Conditions of Sale.

I recommend establishing those provisions once rather than creating different jurisdiction or arbitration clauses across multiple Cone Pros policies.

REGULATORY & INTENDED-USE NOTICE

Last Updated: September 29, 2026

This Regulatory & Intended-Use Notice applies to products and services offered by Cone Pros, a brand of Dank’s Industries, LLC (“Cone Pros,” “we,” “us,” or “our”).

Cone Pros supplies cones, tubes, tips, wraps, packaging, flavoring, components, and custom-manufactured products to customers operating in a variety of markets. Laws and regulatory requirements may differ significantly depending on the product, its contents, intended use, labeling, distribution channel, and jurisdiction in which it is sold.

1. Product & Material Information

Cone Pros is committed to carefully sourced materials, quality manufacturing, and appropriate product testing.

Where applicable, we may provide product specifications, laboratory testing, material information, certificates, or other documentation relating to particular products.

Any testing result, certification, specification, or compliance representation applies only to the particular product, material, production lot, or scope identified in the applicable documentation.

It should not be interpreted as a certification of a Customer's finished product unless expressly stated.

2. Regulatory Requirements Vary

Products that are lawful or appropriate for one application or market may be subject to different requirements in another.

Requirements may depend on factors including:

  • Product type and intended use
  • Materials and ingredients
  • Product contents
  • Packaging and labeling
  • Marketing claims
  • Customer age restrictions
  • Distribution method
  • State, federal, provincial, national, or local law
  • Import and export requirements

Cone Pros does not represent that every product is suitable or legally compliant for every possible application or jurisdiction.

3. Customer Responsibility

Customers are responsible for determining whether their finished products and intended uses comply with laws and regulations applicable to their businesses and markets.

This includes responsibility for requirements concerning:

  • Finished-product composition
  • Product contents
  • Packaging
  • Labeling and warnings
  • Advertising and marketing claims
  • Testing
  • Registration or licensing
  • Distribution
  • Age restrictions
  • Import and export
  • Retail or wholesale sale

Cone Pros' manufacture or sale of a component does not constitute approval of the Customer's finished product or intended commercial use.

4. Customer-Specified Products

When Cone Pros manufactures a product according to Customer-provided specifications, artwork, labeling, ingredients, claims, or other instructions, the Customer is responsible for ensuring those instructions are appropriate and lawful for the Customer's intended market.

Cone Pros may decline a project or requested specification when we reasonably believe it may violate applicable law, create a safety concern, infringe third-party rights, or otherwise present an unacceptable risk.

5. Testing & Laboratory Reports

Certain Cone Pros materials or products may undergo laboratory testing.

Testing may include analyses for characteristics or substances relevant to the particular material or product, such as cannabinoids, residual solvents, heavy metals, pesticides, microbial contaminants, or other specified parameters.

Where Cone Pros provides a laboratory report, certificate of analysis, or similar document, Customers should review the actual report, test methodology, sample identification, applicable limits, date, and scope rather than assuming that the report establishes universal regulatory compliance.

6. Hemp & Plant-Derived Materials

Where products contain hemp or other plant-derived materials, natural variation may occur between agricultural inputs and production batches.

Testing or specifications relating to one batch do not necessarily establish the characteristics of every future batch unless the applicable testing program or documentation expressly states otherwise.

Any representations regarding hemp origin, composition, testing, or other characteristics should be interpreted according to the product-specific documentation supplied by Cone Pros.

7. Rolling Papers, Wrappers & Colorants

Cone Pros selects papers, wrappers, colorants, adhesives, and related materials based on their intended manufacturing applications and applicable product specifications.

Material characteristics or suitability statements apply to the material and use for which they are provided.

Customers incorporating Cone Pros materials into a finished product remain responsible for determining whether additional testing, labeling, certification, or regulatory requirements apply to that finished product.

8. Flavoring Products

Flavoring products may be subject to different requirements depending on their formulation, intended application, method of use, finished-product composition, and jurisdiction.

A material's suitability for one application should not be interpreted as approval for every possible method of use.

Customers are responsible for following applicable product instructions and determining whether a particular flavoring product is appropriate for their intended application.

9. Packaging & Labeling

Cone Pros may manufacture or supply custom packaging, labels, cigar bands, stickers, printed materials, and other branded components based on Customer-supplied artwork and instructions.

Unless Cone Pros expressly agrees in writing to provide regulatory labeling services, Customer approval of packaging artwork confirms the Customer's responsibility for the regulatory content of that artwork, including required warnings, disclosures, symbols, statements, and other labeling requirements.

Production of Customer-approved packaging does not constitute Cone Pros' legal or regulatory approval of the labeling.

10. Regulatory Changes

Laws, regulations, testing standards, labeling requirements, and agency interpretations may change.

Information or documentation that was appropriate when issued may not remain applicable indefinitely.

Customers should evaluate current requirements applicable to their products and markets, particularly when entering a new jurisdiction or introducing a new product.

11. No Legal or Regulatory Advice

Information provided by Cone Pros regarding materials, testing, regulations, or product requirements is intended to assist Customers in evaluating products and is not legal or regulatory advice.

Customers should obtain advice from qualified professionals when necessary to determine requirements applicable to their particular products and businesses.

12. No Authorization for Unlawful Use

Cone Pros products are offered for lawful commercial and consumer applications.

Nothing on our website, in our product literature, or in communications with Cone Pros should be interpreted as encouraging or authorizing the possession, manufacture, distribution, sale, or use of any substance or product in violation of applicable law.

13. Documentation Requests

Customers requiring specifications, available testing documentation, certificates, or other product information for a particular application should contact Cone Pros before ordering when those requirements are material to the purchasing decision.

Where available, documentation will identify the product, material, test, or production scope to which it applies.

14. Relationship to Other Policies

This notice should be read together with our Terms & Conditions of Sale, Custom Manufacturing & Artwork Policy, Shipping & Delivery Policy, and other applicable Cone Pros policies.

A specific written certification or representation provided by Cone Pros for a particular product takes precedence over a general statement in this notice with respect to the subject of that certification.
